So your neighbour is planning an upcoming building project, what do you need to do next?


Has Your Neighbour Served You With a Party Wall Notice?

Yes
If you have been served with a Party Wall Notice then it should include an acknowledgement letter that lists out your options. We will go through these options below.

Option One: You Can Consent To The Notice
You can simply consent to the notice and your neighbour can begin works straight away.

Option Two: You Can Consent To The Notice Subject To a Schedule of Condition Report
You can simply consent to the notice on the condition that an inspection is made of your home beforehand and a record of its condition made. In the event of any damages to your home this report can be used to demonstrate whether or not the damage was pre-existing.

Option Three: You Can Consent To The Notice and Concur in the Appointment Of Your Neighbours Surveyor To Act As The Agreed Surveyor For Both of You.
You can dissent to the notice, which will provide you with the full protection that the Party Wall etc. Act 1996 provides you with. By concurring in the joint appointment of your neighbours surveyor you will also be reducing the legal costs of your neighbours as in the majority of cases a single surveyor will generally cost less that appointing two surveyors.

Option Four: You Can Dissent To The Notice And Appoint Your Own Independent Surveyor
You can dissent to the notice, which will provide you with the full protection that the Party Wall etc. Act 1996 provides you with.
You are also entitled to appoint your own independent surveyor to safeguard your interests.
The costs associated with you appointing your own surveyor are covered by the person carrying out the notifiable building works.

If your neighbour is looking to carry out building operations or even if they have already started and they have not served you with the appropriate Party Wall notices then they may be in breach of the Party Wall etc. Act 1996.
